Mr Davies suffered an accident whilst he was working on private property, working on scaffolding.
His work colleague was fitting toe boards on to the scaffolding. When Mr D's colleague's mobile phone rang, he jumped down to answer it leaving a toe board across the scaffolding. He indicated to Mr D to go up the scaffolding and fit the safety rails. As Mr D went to do the task he tripped over the toe board and fell from the scaffolding.
Mr D's fall resulted in a shattered heel, fracture to his heel and severed nerves. He was unable to return to his preferred job and had to find alternative work as a result of the accident.
